VIVIBIT Product Warranty

Thank you for purchasing VIVIBIT products.

This Product Warranty (“Warranty”) describes the warranty coverage applicable to eligible VIVIBIT hardware products purchased through the official VIVIBIT website or authorized sales channels. It also explains the responsibilities of both VIVIBIT and the original purchaser with respect to warranty service.

By purchasing, opening, installing, activating, or using a VIVIBIT product, you acknowledge and agree to this Warranty. If you do not agree, you should stop using the product and consult the applicable seller’s return policy, where available.

For purposes of this Warranty, “VIVIBIT,” “we,” “our,” and “us” refer to the relevant VIVIBIT entity or affiliate providing the product, and “you” refers to the original end customer or entity that purchased the product from an authorized source.

1. Scope of Warranty

This Warranty applies only to eligible VIVIBIT hardware products purchased:

  • from the official VIVIBIT website; or

  • from an authorized VIVIBIT distributor, reseller, or channel partner.

This Warranty applies only to the original purchaser and is not transferable unless otherwise required by applicable law.

This Warranty covers defects in materials and workmanship under normal intended use during the applicable warranty period. It does not guarantee uninterrupted operation, complete compatibility with all environments, or error-free performance in all deployment conditions.

2. Products Covered

This Warranty may apply to the following categories of eligible products, unless otherwise stated on the product page, in the product documentation, or in a separate written agreement:

  • VIVIBIT main hardware devices and platforms;

  • VIVIBIT-branded standard accessories included in the original package or sold separately by VIVIBIT;

  • selected bundled components expressly identified by VIVIBIT as covered under this Warranty.

For avoidance of doubt, product categories currently shown on the VIVIBIT store include both infrastructure hardware products such as E1001, E1001 Lite, E1001 NX, and E1005, and standard accessory products such as the 200G QSFP56 to 4x50G QSFP56 DAC Cable. y Period

Unless otherwise stated on the product page, packaging, purchase documentation, or in a separate written agreement, the standard warranty periods are as follows:

Main hardware devices

2 years from the date of delivery or the date shown on the valid proof of purchase, whichever can be reasonably verified by VIVIBIT.

Standard VIVIBIT-branded accessories

1 year from the date of delivery or the date shown on the valid proof of purchase, whichever can be reasonably verified by VIVIBIT.

Third-party components or bundled third-party products

If a product includes components manufactured by a third party, including but not limited to storage media, drives, modules, or other third-party branded parts, such components may be subject to the warranty terms and warranty period offered by the original manufacturer, unless otherwise stated by VIVIBIT in writing.

If there is a conflict between the warranty rules of an online platform, mandatory local consumer laws, and this Warranty, the mandatory legal requirements or the applicable platform rules will prevail to the extent required.

4. Start of Warranty Coverage

The warranty period generally begins on the date shown on:

  • the purchase receipt,

  • invoice,

  • order confirmation,

  • shipment confirmation, or

  • other valid proof of purchase accepted by VIVIBIT.

For products that support registration, activation, or online service association, VIVIBIT may also use device registration or activation data as supporting evidence to verify warranty eligibility, but such data does not reduce any rights you may have under mandatory applicable law.

5. What This Warranty Covers

If an eligible VIVIBIT product fails due to a defect in materials or workmanship during the applicable warranty period and under normal intended use, VIVIBIT may, at its discretion:

  • repair the product;

  • replace the product with the same or a functionally equivalent product;

  • replace defective parts or components; or

  • provide another commercially reasonable remedy.

Replacement products may be new, refurbished, or functionally equivalent units, to the extent permitted by applicable law.

Warranty service is available only after VIVIBIT verifies the issue and confirms that the product is eligible for coverage.

6. What This Warranty Does Not Cover

To the fullest extent permitted by applicable law, this Warranty does not cover:

  • normal wear and tear, cosmetic damage, discoloration, scratches, dents, or aging from ordinary use;

  • damage caused by misuse, abuse, accident, improper handling, negligence, improper transport, or improper storage;

  • damage caused by operation outside documented environmental, electrical, thermal, or installation requirements;

  • damage caused by improper installation, improper integration, or use with incompatible hardware, software, networks, or systems;

  • compatibility issues, configuration misunderstandings, deployment limitations, or changes in customer requirements after purchase;

  • damage caused by unauthorized repair, modification, disassembly, alteration, or tampering;

  • products with removed, altered, defaced, or unreadable serial numbers or identifying labels;

  • damage caused by power surges, unstable power supply, fire, flood, earthquake, lightning, corrosion, contamination, or other external causes;

  • damage caused by viruses, malware, cyberattacks, unauthorized access, or third-party actions;

  • consumable or limited-life components, unless failure occurred due to a defect in materials or workmanship;

  • data loss, data corruption, configuration loss, interruption of service, business loss, or loss of use;

  • products not purchased through official or authorized channels;

  • products sold as final sale, as-is, used, refurbished, or non-returnable, unless expressly stated otherwise in writing.

7. Data Backup and Customer Responsibility

Before sending any product for inspection, repair, replacement, or other warranty service, you are responsible for:

  • backing up all data, files, logs, settings, credentials, and configurations;

  • removing sensitive, confidential, regulated, or personal information where appropriate;

  • disconnecting or uninstalling any non-original accessories, add-ons, or user-installed components unless otherwise instructed;

  • restoring the product to a state reasonably suitable for service, where applicable.

VIVIBIT is not responsible for loss, corruption, disclosure, recovery failure, or compromise of data, configurations, or software environments during inspection, repair, replacement, transport, or related service activities, except to the extent required by applicable law.

8. Third-Party Components and Customer-Installed Parts

If a product includes or is used with third-party components, customer-installed parts, storage devices, drives, cables, adapters, or software not supplied or approved by VIVIBIT, VIVIBIT may limit or refuse warranty service to the extent the issue is caused by or materially related to such items.

Third-party components may be subject to the original manufacturer’s warranty terms instead of this Warranty.

VIVIBIT is not responsible for loss of any non-original or non-preinstalled parts shipped with a returned product unless we specifically instructed you to include them.

9. How to Obtain Warranty Service

To request warranty service, please contact VIVIBIT using the contact information provided on the official VIVIBIT website.

You may be required to provide:

  • proof of purchase;

  • product model and serial number;

  • order number;

  • a description of the issue;

  • photos or videos of the issue, product condition, packaging, or labels;

  • your contact details; and

  • any troubleshooting information reasonably requested by VIVIBIT.

VIVIBIT may require remote diagnostics, troubleshooting steps, logs, photographs, or additional verification before approving warranty service.

Do not send any product to VIVIBIT without prior authorization and service instructions.

10. Return for Warranty Inspection

If VIVIBIT authorizes a return for inspection, repair, or replacement:

  • the product must be packaged appropriately to prevent transit damage;

  • you must follow the shipping and packaging instructions provided by VIVIBIT;

  • you should not include items that were not originally supplied with the product unless specifically requested;

  • unauthorized returns may be refused or returned at your expense.

VIVIBIT reserves the right to inspect and verify products returned for warranty claims and may deny warranty service if the product does not meet the conditions of this Warranty.

Products rejected under non-covered circumstances may be returned to you at your expense, where permitted by applicable law.

11. Shipping Costs for Warranty Service

If VIVIBIT confirms that the issue is covered by this Warranty, VIVIBIT may, at its discretion:

  • provide a prepaid shipping label,

  • reimburse reasonable shipping costs,

  • arrange return logistics, or

  • provide another practical service solution.

If the issue is not covered by this Warranty, you may be responsible for shipping costs, inspection fees, repair fees, parts charges, taxes, duties, or other related costs, subject to applicable law.

12. Repair and Replacement Warranty

If a product is repaired under warranty, the repaired product or replaced part will generally be covered for the remainder of the original warranty period or for 90 days after service, whichever is longer, unless a longer period is required by applicable law.

If VIVIBIT replaces the product under warranty, the replacement product will generally assume the remaining warranty period of the original product, unless otherwise required by law or expressly stated in writing.

13. Warranty Exclusions for Commercial, Project, and Custom Deployments

Where products are purchased under enterprise, project-based, bulk, negotiated, special pricing, or custom deployment arrangements, separate warranty or service terms may apply.

If a separate written agreement applies, that agreement will govern to the extent of any conflict with this Warranty.

For configurable or deployment-sensitive products, VIVIBIT does not warrant that the product will meet every customer-specific environment, integration requirement, workflow expectation, or third-party compatibility scenario unless expressly confirmed in writing.

14. Disclaimer of Additional Warranties

Except as expressly stated in this Warranty or as required by applicable law, VIVIBIT disclaims all other warranties and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

No reseller, distributor, agent, employee, or other person is authorized to modify, extend, or add to this Warranty unless expressly authorized by VIVIBIT in writing.

15. Limitation of Liability

To the fullest extent permitted by applicable law, VIVIBIT shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising out of or relating to the product, this Warranty, or the inability to use the product, including loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings.

To the extent liability cannot be excluded, VIVIBIT’s total liability under this Warranty shall not exceed the amount actually paid for the product giving rise to the claim, excluding taxes, shipping charges, and ancillary fees, unless otherwise required by law.

Nothing in this Warranty excludes liability that cannot be excluded or limited under applicable law.

16. Export Control and Restricted Use

You agree to comply with all applicable export control, sanctions, customs, and trade laws relating to the purchase, transfer, shipment, export, re-export, and use of VIVIBIT products.

You may not export, re-export, transfer, or use VIVIBIT products in violation of applicable laws or for prohibited end uses.

VIVIBIT may refuse warranty service, shipment, or support where export control, sanctions, or regulatory restrictions apply.

17. Geographic Limitations

Warranty service availability may vary by country or region.

Unless otherwise required by law, VIVIBIT may limit or refuse cross-region warranty support where:

  • the product was purchased in a different market or channel;

  • the product is not sold or supported in the requested service location;

  • legal, customs, logistics, export, or regulatory restrictions apply; or

  • product configuration or local certification differences materially affect serviceability.

18. Governing Law and Dispute Resolution

This Warranty shall be governed by and construed in accordance with the laws specified by the legal entity operating the relevant VIVIBIT sales channel or by any separate written agreement applicable to your purchase, without regard to conflict of law principles.

Any dispute arising out of or relating to this Warranty shall be resolved in accordance with the dispute resolution mechanism specified by the applicable VIVIBIT entity or any separate written agreement, to the extent permitted by law.

19. Miscellaneous

If any provision of this Warranty is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in effect to the maximum extent permitted by law.

This Warranty gives you specific legal rights, and you may also have additional rights that vary by jurisdiction.

This Warranty applies only to products purchased through the official VIVIBIT website or authorized sales channels, unless otherwise stated in writing.
